As you know, MJ justice groups have been complaining about the involuntary manslaughter charge ever since Murray was initially charged. They have come up with all kinds of reasons why the charge should be changed, but none of them are based on the law. JUSTICE4MJ also tweeted this info to get a message to the district attorney: Email/fax DAA David Walgren to change the charges. Flood them by Monday morning. webmail@da.lacounty.gov Fax: 213-974-1484 Right now, a petition has been started by the MJJ Community forum: www.petitiononline.com/justs4MJ/petition.htmlI would be happy to sign it IF I believed that the charge could be upped to 2nd degree murder. But I don't believe that will happen. For Judge Paster to rule on that, there would have to be absolute proof coming out that Murray intentionally killed Michael. From what we've already heard, I believe Murray through his own incompetence, carelessness, recklessness and stupidity, let Michael die. He was sweating bullets when he realized that, and knew then that his life would be over as he knew it. Now IF Judge Pastor elevated the charge to Murder 2, that would be unprecedented! That sort of thing just doesn't ever happen. There is another reason that the DA chose to charge Murray with involuntary manslaughter. It would be much easier to prove than Murder 2, and they would have a better chance at seeing a conviction. By the way, read my thoughts on a possible plea deal under Victories & the Fight for Justice! It's another important option the defense could take, meaning that Murray would have to change his plea to GUILTY! As for his medical licence to practice, he can pretty well wave bye bye to that! His career is DONE! Now this is just speculation on my part, but I can't think of a better reason for Judge Pastor to take it away for good.

Well, sistas "dis is the troot"- Murray is going down real soon. No self respecting judge would consider not having a trial now. There is so much evidence against Murray. Murray"s defense is all hear say - no proof and that doesn't cut it in a court of law. Justice for Michael! Hang tight we are almost there.

Agreed, Judith. This case will definitely go to trial, so no one should worry that it won't happen. The only other way it wouldn't, is if Murray's team accepted a plea deal. The DA and the Prosecution are hoping for this, because then California would be saved the time and millions of $ to go to trial.
So either way, we will see justice for Michael!

I am ecstatic that we have seen justice. And I'm glad that the Murder 2 idea has finally been put to rest. Although we would have liked Murray to be charged with 2nd degree murder, the evidence just wasn't there. Murray did NOT intend to kill Michael, since we heard at the hearing he was freaking out, trying to cover up what he had done. Some MJ justice groups wanted to re-write history, changing the facts to suit their needs/beliefs, but it just doesn't work that way. The truth is not always easy to face, so some choose not to face it. and will spread a rumor getting others to believe their version of past events But the hearing happened, the sad truth was finally revealed and justice has been done. Murray will be arraigned on January 25th, meaning he will be called back to court where Judge Pastor will set the start date for his trial, for involuntary manslaughter of Michael Jackson. JUSTICE for Michael!

Fans have been saying that Murray being sent to trial to face the charge of involuntary manslaughter is a small victory, just the first step. But I disagree! I see it as a HUGE victory! Sure, the trial hasn't started yet, but just the fact that he agreed to a trial and suspended his medical licence is HUGE!
This vindicates Michael... it's obvious from the pre-trial hearing that Michael was NOT at fault for his death, and only Murray was to blame. No matter if Michael was addicted to drugs or not, we know who was his pusher! And now the world knows too.
I also wanted to add that I'm glad the charge wasn't changed to 2nd degree murder, because it would be much tougher to prove, the jury would not convict and Murray could easily walk, and we don't want that! Let's look at it this way... his length of time served in prison is not that important. What is more important? To see justice for Michael, to see the doctor responsible for his death be found GUILTY for his crime and punished according to Judge Pastor's ruling.
His ruling will be out of our hands and we will have no control. But what we can do then is PRAY he decides on a sentence for Murray that best fits the crime. What do you think... do you agree or disagree?

Just to reinforce my view on Murder 2, Thomas Mesereau speaks exactly about this subject in the video:
If anyone knows California law, Mesereau does! Plus the DA and Prosecution know better than we do, how they are going to work this case in order to see a conviction. Now we need to wait for January 25th, just 9 days away!

A charge of Murder must prove, “a human being has killed another human being with malice aforethought’ Can the DA prove this? It’s risky business. Murray can be proven inept, irresponsible, inattentive, clueless, greedy, a dead beat dad, and a dr. without ethics, morals and integrity.. but a murderer with “malice aforethought”….is going to be a stretch, and why give that little "beyond a reasonable doubt" gift to a jury, who may not be sympathetic to MJ?
Now let’s examine Involuntary Manslaughter.
The Los Angeles DA's office has charged Murray with Involuntary manslaughter ...Definition - "is the unlawful killing of a human being without malice aforethought. It is distinguished from voluntary manslaughter by the absence of intention. It is normally divided into two categories; constructive manslaughter and criminally negligent manslaughter."
Reasonable doubt should not be a problem in this case.
#1 Jury can believe that Murray did not act with malice .. Heck, he was pulling 150K a month ..and all he had to do was take care of ONE man. .. Dr. Greed acted "without malice aforethought". I would say no aforethought. period, full stop
#2 He broke from standard medical practice. Propofol is administered as an anesthetic and should only be used in a hospital setting, with proper monitoring machines. (fact confirmed by any physician with just a modicum of ethics)
#3 Murray administered Propofol to Michael Jackson in a family home environment without the proper monitoring equipment. (if the defense wants to lay this preposterous "he injected himself" theory...this would have to mean that Murray filled a syringe and left it on the night stand. Do they really want to go there? Are they really going to admit that this 'doctor', and I use the term loosely, left a syringe of deadly anesthesia on a night stand, out in the open, in a house with children milling in and out of their father's bedroom? Seriously? Shall we add Reckless Child Endangerment to the list of charges as well? )
#4 After administering this anesthetic failed to give the most basic of care and attention.. ... He left the room to go talk to one of his babies mommas..(I am not making this up.. its in the timeline) apparently this man has offspring by many women, this indicates a lack of character (he doesn't take proper precautions while having sex either, I see a pattern) and it's been reported that he was behind in child support. ( really now- 150K and can't pay child support?)
There is no reasonable doubt in this case of involuntary manslaughter, Murray without malice aforethought, killed another human being.
This is PROVEABLE offense.
Let's examine the jury pool -
Even though the press has bullied, distorted facts of his life, and mischaracterized Michael Jackson in an effort to dehumanize for 20 years - fact is - he was a loving human being, father, son and brother. His philanthropic mission far surpasses anyone in modern times, but the public never heard THAT because it was better for readership to create a caricature of a "freak" for public consumption and to sway public opinion. It is important to remember that the Michael Jackson that most of the general public knows is the one the MEDIA created. Remember, the possibility of brainwashed individuals sitting in the jury box, is high. Will they care that this ‘freak’ has been murdered? Some comments I’ve seen profess a joy at the thought of his passing. We don’t want to give them a way OUT of convicting Murray.
So you see, the DA may have some wisdom in going after the involuntary manslaughter charge, even though it rankles us.
