Katherine Jackson Sues AEG Over Michael's Death 31 minutes ago by TMZ Staff
Katherine Jackson and Michael Jackson's children are suing AEG Live -- claiming the company breached their agreement to provide physical care for Michael Jackson -- and that AEG was negligent in their hiring of Conrad Murray as MJ's doctor.
In the suit, Katherine claims AEG's contract with Michael "created a legal duty for AEG to act reasonably toward the physical well-being of Michael Jackson."
In the document, Katherine also blames AEG for hiring Dr. Murray without a proper background check -- claiming, "AEG did not provide a doctor who was truly looking out for Jackson's well-being and did not provide equipment."
The suit also alleges AEG caused emotional distress to Michael's son Prince because he witnessed Michael suffering and dying, and "he was put in a position as bystander to these tragic events."
Kenny Ortega, who produced the planned London concerts for Michael, is also named as a defendant.
The attorney who filed the suit, Brian J. Panish, released a statement saying, "The purpose of this lawsuit is to prove to the world the truth about what happened to Michael Jackson, once and for all."

Important news about Kenny Ortega and this lawsuit... and I agree with him. In fact, I believe Katherine's lawsuit will be thrown out, because AEG did not hire Murray. Michael did back when he was living in Vegas.

The producer/director of Michael Jackson's "This Is It" tour is scoffing at Katherine Jackson's wrongful death suit in which he's named as a defendant, because he had nothing to do with the drugs or treatment that caused the singer's death.
Kenny Ortega just filed legal docs -- obtained by TMZ -- asking the court to remove him as a defendant in Katherine's suit, claiming, "Kenneth Ortega is not alleged to be involved in the medical treatment or administration of drugs that allegedly caused Michael Jackson's death."
Ortega's lawyer adds ... Kenny never had a contract with Dr. Conrad Murray or with Michael Jackson, nor has he had any official affiliation with AEG.
Ortega's lawyer says, "The naming of Kenneth Ortega as a defendant in this action, without any basis, without any substantive charging allegations against him, is a gross error."

Katherine Jackson has just filed legal docs claiming AEG was well aware ... there were life-threatening activities going down at Michael Jackson's house ... yet the company turned a blind eye.
Katherine is challenging AEG's motion to dismiss the wrongful death lawsuit against the company.
In her docs, Katherine says AEG retained Dr. Conrad Murray for an "exorbitant salary of $150,000 monthly," and in return Murray agreed to "get Jackson to attend rehearsals and perform."
Katherine's lawyers claim it should have been obvious to AEG when Murray requested CPR equipment at MJ's home that "the medical treatments being administered risked stopping Jackson's heart and breathing."
Katherine's lawyer continues, "This is hardly the type of risk expected in an ordinary house visit from a family doctor."
The lawyers claim, "AEG should have known that the course of treatment being administered by Dr. Murray was unorthodox and unsafe."

Here is the latest on this... As for Kenny being dropped from her lawsuit, Randy J tweeted the other day that the family does not agree that Kenny should have been dropped, or at least some of them. Some of them still blame him for pushing Michael when he wasn't physically or emotionally ready. I understand that Randy and the Jacksons are still grieving so much, so of course they want to find blame wherever they can, to vindicate Michael somehow. However, Michael had his own mind and I believe he really wanted to do these concerts. There are just too many clues pointing to that, including Michael's own tweets in June, 2009. Maybe Randy doesn't even know that Michael was tweeting about it? All I know is, Michael was really looking forward to the London concerts, and looking ahead to the future!

Personally, I don't think there is anyone to blame for Michael's death except Conrad Murray. However, I perfectly understand the Jacksons and their need to find some kind of justice for Michael, wherever they believe it may be found.

I understand it perfectly too, Iris. Unfortunately, whenever Randy tweets about these things, it starts up a controversy and we see a bunch of fans bashing the family and each other with their own opinions. It's really very sad to watch This is why I wish Randy would stop tweeting that we don't know everything and the truth will come out, as if they have many secrets they are keeping from the fans. In my opinion, the truth will indeed come out during the trial, whether we want to hear it or not. We just need to be patient, and have faith we will see justice for Michael.

Speaking of the controversy stirred up by LaToya on her media circuit promoting her new book, Katherine has just made the following statement to TMZ:

Katherine Jackson tells TMZ she knows of NO evidence to support the conspiracy theory that people connected with the Michael Jackson Estate killed the singer.
A number of people, including LaToya Jackson, have suggested there was a conspiracy to kill Michael, and LaToya has said she believes Estate honchos were involved.
Katherine tells TMZ ... "It is only natural for people who loved Michael, including family members, to be suspicious about the circumstances surrounding Michael’s untimely death. So far I have not seen one shred of evidence that anyone associated with Michael’s estate conspired to kill him.
She continues, "If such evidence ever comes to my attention I will be the first to bring those facts to light. No one loved Michael more than I loved him, but no one should be falsely accused, as Michael was, of a crime they did not commit."

I'm SO glad that Katherine has finally made a statement about this. In my opinion, LaToya and Randy and Jermaine have been speaking against the Estate for far too long which not having any facts to back up their claims. Katherine is right on that the Estate should not be unfairly accused if there is NO evidence! Just lots of speculation and innuendo... the same kind that brought down Michael's reputation. I really hope this puts an end to the siblings stirring up their stupid theories and riling up the fans!

LOL Marty, LaToya and her mom are tight! The very same day Katherine made her statement, they came together for the press conference announcing the Michael Forever Tribute Concert! Yup those crazy Jacksons... gotta love them! By the way, the other day on The View, Whoopi Goldberg stopped the general discussion to read a statement from the Michael Jackson Estate refuting La Toya's assertion that MJ's family has not received any money. They said that the estate has paid out $9,000,000 to Mrs. Jackson and the children, including $4,000,000 to pay off the family home. So much for LaToya's claims
